Reassessing Indonesia’s Government Policy To Promote Decent Work For Indonesian Domestic Workers (idws)

Paper Abstract / Summary:

The purpose of this paper is to reassess the current policies of the Indonesian government to
address the high incidence of abuse of Indonesian Domestic Workers (IDWs) abroad and to
promote decent work. Law No. 39/2004 which regulates the placement and protection of IDWs
abroad has had limited success in securing the protection of IDWs. The inappropriate predeparture
training and high recruitment costs borne by the IDW are the main reasons for the high
vulnerability of IDWs. The induced “Zero Domestic Worker Roadmap” addresses the issue of the
debt bondage of IDWs but it is inefficient in its main purpose of achieving a zero domestic
worker export quota and promoting decent work as it does not focus on the forces of migration
and the actual needs of IDWs, bringing the danger of increased illegal migration and
employment.


Rather than impeding the outflow of migrating IDWs, this paper suggests focusing on the
improvement of pre-departure training on increased awareness of labor rights and support in case
of abuse. In combination with the pre-departure training program, it recommends transferring the
lion’s share of the recruitment cost to the employer as this will not decrease current labor demand
for domestic work and will reduce IDWs’ vulnerability. However, in order to achieve sustainable
outcomes for the Zero Domestic Worker Roadmap in the long run, the government must set out
policies to address the push and pull factors, and lower incentives for prospective IDWs to
migrate. Programs that effectively promote education for rural families will naturally and
gradually scale down the large supply of IDWs and contribute to the overall welfare of
Indonesian’s society.
